1. Introduction and Acceptance
Welcome to Party Paradise Australia. These Terms of Service ("Terms") govern your use of our event planning services, website, and all related services provided by Party Paradise Australia ("we," "our," or "us"). By engaging our services or accessing our website, you ("Client" or "you") agree to be bound by these Terms.
These Terms constitute a legally binding agreement between you and Party Paradise Australia. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website.
2. Service Description
2.1 Event Planning Services
Party Paradise Australia provides comprehensive event planning and coordination services including, but not limited to:
- Birthday party planning and coordination
- Corporate event management
- Wedding planning and coordination
- Anniversary celebrations
- Venue selection and booking assistance
- Vendor coordination and management
- Event design and decoration services
- Entertainment booking and coordination
- Catering coordination
- Event timeline development and management
2.2 Service Limitations
Our services are subject to availability and may be modified based on specific client requirements, venue restrictions, and vendor availability. We do not guarantee the availability of specific vendors, venues, or entertainment options, though we will make every reasonable effort to fulfill client requests.
3. Booking and Payment Terms
3.1 Service Agreement
All event planning services require a signed service agreement and deposit before work commences. The service agreement will outline specific services, timelines, costs, and deliverables for your event.
3.2 Payment Schedule
- Deposit: 50% of total service fee due upon signing the service agreement
- Progress Payment: 30% due 30 days before the event date
- Final Payment: Remaining 20% due 7 days before the event
- Additional Costs: Any additional services or changes requested after the initial agreement will be invoiced separately
3.3 Payment Methods
We accept payment via bank transfer, credit card, and certified check. All payments must be made in Australian Dollars (AUD). Late payments may be subject to interest charges of 1.5% per month on outstanding balances.
4. Cancellation and Refund Policy
4.1 Client Cancellations
- More than 90 days before event: 75% refund of payments made
- 60-90 days before event: 50% refund of payments made
- 30-59 days before event: 25% refund of payments made
- Less than 30 days before event: No refund available
4.2 Postponements
Events may be postponed once without penalty if notice is given at least 60 days in advance. Subsequent postponements or postponements with less notice may be subject to additional fees based on costs already incurred.
4.3 Force Majeure
In cases of force majeure events (including but not limited to natural disasters, government restrictions, venue closure, or pandemic-related restrictions), we will work with clients to reschedule events when possible. Refunds in force majeure situations will be determined on a case-by-case basis.
5. Responsibilities and Limitations of Liability
5.1 Our Responsibilities
Party Paradise Australia commits to providing professional event planning services with reasonable skill and care. We will coordinate with vendors, manage timelines, and oversee event execution as outlined in the service agreement.
5.2 Client Responsibilities
- Provide accurate and complete information for event planning
- Make timely payments according to the agreed schedule
- Communicate changes or requirements in a timely manner
- Obtain necessary permits, licenses, or insurance as required
- Ensure guest behavior and venue compliance during events
- Review and approve all plans, vendor selections, and arrangements
5.3 Limitation of Liability
Party Paradise Australia's liability is limited to the total amount paid for our services. We are not liable for indirect, consequential, or punitive damages. We do not assume responsibility for vendor performance, venue issues, weather conditions, or guest behavior beyond our reasonable control.
6. Third-Party Vendor Relations
While we coordinate and recommend vendors, clients enter into separate contracts with vendors for services such as catering, entertainment, photography, and venue rental. Party Paradise Australia acts as a coordinator and is not liable for vendor performance, quality, or service delivery issues.
We recommend that clients review all vendor contracts carefully and maintain appropriate insurance coverage for their events. Any disputes with vendors should be resolved directly between the client and vendor.
7. Intellectual Property and Photography
7.1 Event Documentation
Party Paradise Australia may photograph or video events for portfolio and marketing purposes. By engaging our services, clients consent to such documentation unless specifically requested otherwise in writing.
7.2 Design Concepts
All event design concepts, plans, and proprietary planning materials created by Party Paradise Australia remain our intellectual property. Clients may not share or reproduce these materials without express written permission.
8. Privacy and Confidentiality
We respect client privacy and maintain confidentiality of personal information and event details. Our full privacy policy can be found on our website. We will not share client information with third parties except as necessary to provide services or as required by law.
Clients are responsible for informing guests about any photography or recording that may take place during events and obtaining necessary consents for the use of guest images in our marketing materials.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of Australia and the state/territory where services are provided. Any disputes arising from these Terms or our services will be resolved through binding arbitration or in the appropriate courts of Australia.
Before pursuing legal action, parties agree to attempt resolution through good-faith negotiation. If negotiation fails, disputes may be submitted to mediation before proceeding to arbitration or litigation.
10. Modifications and Severability
Party Paradise Australia reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with a new effective date. Continued use of our services after modifications constitutes acceptance of updated Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
